What Is A Separation Agreement?
A Separation Agreement is an out-of-court, legally binding contract between two spouses who have decided to separate but are not yet divorced. A well-drafted Separation Agreement typically includes:
- Property Division & Equalization: How assets, savings, investments, and liabilities will be divided.
- Spousal Support: Whether support will be paid, how much, and for how long.
- Child Custody, Decision Making Responsibilities, and Parenting Time: Parenting schedules, decision-making responsibilities, and holiday arrangements.
- Child Support: Payment amounts, frequency, and duration in line with the Child Support Guidelines.
Other Relevant Issues: Any additional agreements such as life insurance, future dispute resolution methods, or special provisions for unique family circumstances.
