What Is Alternative Dispute Resolution ?

Alternative Dispute Resolution (ADR) in Ontario provides separating or divorcing couples with ways to resolve family law issues outside of the courtroom. ADR methods are often faster, less expensive, and less stressful than traditional litigation, while promoting cooperative solutions that focus on the family’s best interests.

Common ADR Options Include:

  • Mediation – A neutral mediator helps both parties communicate and reach a mutually agreeable solution on issues like parenting, property division, and support.
  • Arbitration – A private arbitrator (similar to a judge) makes a binding decision on disputes after hearing both parties’ positions.
  • Collaborative Family Law – Each party works with their own collaboratively trained lawyer to negotiate a settlement in a structured, cooperative process without going to court.
  • Mediation‑Arbitration (Med‑Arb) – A combined approach where parties try mediation first and, if unresolved, the same professional acts as an arbitrator to make a final decision.
