No, unfortunately we do not accept Legal Aid Certificates.
The cost of a family law matter depends on the issues involved, the complexity of the case, and whether the matter can be resolved through negotiation or requires court proceedings.
At Mahin Law, our family lawyers charge an hourly rate, and we charge a fixed fee for uncontested divorces. You will also be asked to provide a retainer, which is an advance payment toward legal fees and expenses.
The best way to understand potential costs for your family law matter is to discuss your circumstances with a lawyer. At an initial consultation, you can tell your story to a family law lawyer, ask about the likely steps involved, and potential costs.
You are not required to have a lawyer to separate or divorce in Ontario. However, getting legal advice before signing an agreement or making important decisions about you and your family can help you understand your rights and obligations.
Legal advice can be particularly important when there are significant assets or debts, children, child or spousal support issues, a family business, disagreements about parenting, or concerns about your spouse's finances.
Even if you and your spouse agree on most issues, each person should generally obtain independent legal advice before signing anything. Changing an order or agreement that you have already signed without legal advice may be extremely complicated and expensive.
There is no single timeline for a separation or divorce. A straightforward matter where both spouses agree on all issues can be resolved relatively quickly, while a highly contested case can take considerably longer.
A separation itself does not require a court process. Spouses can negotiate an agreement dealing with parenting, support, property, and other issues.
A divorce is a separate legal process. In many cases, spouses can apply for a divorce after they have been separated for at least one year, although there are circumstances in which a divorce may be granted on other grounds.
The timeline can be affected by the complexity of the issues, the level of cooperation between spouses, negotiations, mediation, and court scheduling.
In Ontario, decisions about parenting are based on the best interests of the child.
The law focuses on the child's needs, relationships, stability, safety, and overall well-being rather than automatically giving one parent preference.
Parenting arrangements can include where a child lives, how much time they spend with each parent, holidays, vacations, school decisions, medical decisions, communication, and other important aspects of the child's life.
Parents are encouraged to reach agreements where possible. If they cannot agree, a court can make parenting orders based on the child's best interests.
Child support in Ontario is generally determined using the Federal Child Support Guidelines. The amount depends primarily on factors such as the paying parent's income, the number of children, and the province or territory in which the paying parent lives.
There can also be additional contributions for certain expenses, commonly referred to as special or extraordinary expenses, such as some childcare, educational, medical, or extracurricular expenses.
Parenting arrangements can also affect support calculations in certain circumstances.
Because child support calculations can become complicated when income is variable, self-employment is involved, a parent owns a business, or there are shared parenting arrangements, obtaining legal advice can be helpful.
Spousal support is not automatically payable simply because a couple separates.
Whether support is appropriate, how much should be paid, and for how long can depend on factors such as the length of the relationship, the roles each spouse had during the relationship, differences in income, financial need, age, health, childcare responsibilities, and the economic consequences of the relationship and separation.
The Spousal Support Advisory Guidelines can sometimes provide a useful framework for estimating potential support, but they are not legislation and do not determine every case.
A lawyer can assess the specific circumstances and explain whether a claim for spousal support may be appropriate.
